The rules governing your use of the Wangu platform and services.
These Terms of Service ("Terms") govern your access to and use of the Wangu platform, website, mobile application, and related services (collectively, "the Services") provided by Wangu (Pty) Ltd ("Wangu", "we", "us", or "our"), a company registered in South Africa.
By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Services.
These Terms contain important information about your rights and obligations, including limitations of liability and the law that governs disputes. If anything is unclear, contact us at hello@wanguapp.com before using the Services.
Wangu is an all-in-one food commerce platform that enables food businesses ("Restaurant Partners") to accept online orders, manage reservations, coordinate delivery, and build direct customer relationships. Wangu also provides customers ("Customers") with the ability to place orders, book tables, and interact with Restaurant Partners directly.
The Services are currently in pre-launch phase in Gqeberha (Port Elizabeth), Eastern Cape, South Africa, with a planned launch date of 16 June 2026. During the pre-launch and beta period, features and pricing may change and service availability may be limited.
To access most features of the Services, you must create an account. When registering, you agree to:
You must be at least 18 years old to create an account. We reserve the right to refuse registration or terminate accounts at our discretion.
Restaurant Partners must be legally registered businesses or sole traders operating a food business in South Africa. By registering as a Restaurant Partner, you represent that all information provided is accurate and that your business complies with all applicable food safety, health, and business laws.
Restaurant Partners are solely responsible for the accuracy of their menu listings, including item descriptions, allergen information, and prices. Wangu does not verify the accuracy of this information. Restaurant Partners must not list items they cannot fulfil or at prices that differ materially from in-store prices without clear disclosure.
Restaurant Partners are responsible for preparing and packaging orders accurately and within the estimated preparation time displayed on their store. Persistent failure to fulfil orders or excessive cancellations may result in account suspension.
Restaurant Partners agree to the commission rates and fee structures set out in their service agreement with Wangu. Payouts are made to the bank account registered during onboarding, subject to the payment schedule in force at the time. Wangu reserves the right to withhold payment where there is reasonable suspicion of fraud or a pending dispute.
When placing orders through the Services, Customers agree that:
Customers are responsible for providing accurate delivery addresses. Wangu and Restaurant Partners are not responsible for failed deliveries caused by incorrect address information.
Delivery drivers who partner with Wangu operate as independent contractors and are not employees of Wangu (Pty) Ltd. Drivers must:
Wangu reserves the right to deactivate drivers who receive persistent negative feedback, breach these Terms, or engage in conduct that reflects poorly on the platform.
All payments are processed by Paystack, a licensed payment service provider. By using the Services to make or receive payments, you also agree to Paystack's terms of service and privacy policy. Wangu does not store card details on its servers.
Delivery fees (ranging from approximately R10 to R35 per order) are charged to Customers and displayed clearly before order confirmation. These fees cover driver compensation and are not retained in full by Wangu.
Wangu's commission rates and subscription plan pricing are as listed on wanguapp.com/pricing and in each Restaurant Partner's service agreement. Wangu reserves the right to change pricing with at least 30 days' written notice to existing Restaurant Partners.
Refund eligibility depends on the nature of the issue and the Restaurant Partner's policy. Wangu will facilitate dispute resolution but is not responsible for refunding amounts on behalf of Restaurant Partners in cases involving food quality disputes.
You agree not to:
Violation of this section may result in immediate account termination without refund.
All intellectual property in the Services — including the Wangu name, logo, software, design, and content produced by Wangu — is owned by or licensed to Wangu (Pty) Ltd. You may not copy, reproduce, modify, or distribute any part of the Services without our express written consent.
By submitting content to the platform (such as menu images, reviews, or profile information), you grant Wangu a non-exclusive, royalty-free licence to use, display, and reproduce that content in connection with operating the Services.
The Services are provided "as is" without warranty of any kind. To the maximum extent permitted by South African law, Wangu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Wangu is a technology platform connecting Restaurant Partners, Customers, and Drivers. We are not a restaurant, a food manufacturer, or a logistics company. We do not prepare, handle, or inspect food. Responsibility for food quality, safety, and allergen information rests entirely with the Restaurant Partner.
To the fullest extent permitted by law, Wangu's liability to any user for any claim arising out of or relating to the Services is limited to the amount paid by that user to Wangu in the 3 months preceding the claim.
You agree to indemnify, defend, and hold harmless Wangu (Pty) Ltd and its directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) content you submit to the platform.
Either party may terminate the service relationship at any time. Restaurant Partners wishing to close their account should provide 30 days' notice to allow for outstanding order fulfilment and final payment processing. Wangu reserves the right to terminate accounts immediately for serious violations of these Terms without notice or refund.
On termination, your access to the Services will cease. Wangu will retain data as set out in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including payment obligations, intellectual property, and disclaimers) will continue to apply.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms will first be subject to good-faith negotiation. If negotiation fails, disputes will be submitted to the jurisdiction of the courts of the Republic of South Africa.
Restaurant Partners located in South Africa may also have rights under the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002, which are not excluded by these Terms.
We may update these Terms to reflect changes in the law, our Services, or our business practices. We will post the updated Terms on this page and update the effective date. For material changes, we will provide at least 14 days' notice via email or a prominent notice on the platform. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.
